LA Court Orders Paternity Test For Anna Nicole Smith's Daughter

Los Angeles, CA (AHN) - A Los Angeles court has reportedly ordered a paternity test for three-month-old daughter of former reality TV star and Playboy playmate Anna Nicole Smith. Larry Birkhead - who claims to be the father - had filed a lawsuit demanding Smith and her daughter return to California for the test.

"Los Angeles Superior Court has ruled today that Anna Nicole Smith and 3-month-old baby daughter Dannielynn are ordered to submit to paternity testing," Birkhead's publicist says.

Anna was served the court papers in October after Birkhead claimed to be the father of Dannielynn Hope Marshall Stern and complained that she had cut off contact with him.

Dannielynn was born in September in the Bahamas. The birth certificate lists attorney Howard K.

LOS ANGELES - It's double DNA time. A judge Thursday ordered Anna Nicole Smith to provide saliva samples from her daughter and herself for testing to determine who the baby's daddy is.

The ruling from L.A. Superior Court Judge Robert Schneider was a victory for photographer Larry Birkhead, who insists he fathered 3-month-old Dannielynn Hope. Smith, 39, claims her longtime lawyer Howard K. Stern is the papa.

"This is it. This is big," said Birkhead's lawyer Debra Opri. "Larry is ecstatic. He said, 'This is the best Christmas gift I could ever get.' "

Even if Birkhead is determined to be Dannielynn's father, it will not guarantee him any custody rights. He'll still have to battle for those in court.

Smith's lawyer Ron Rale refused to say if he will appeal the DNA ruling.

The ruling, which was revealed on Thursday, came in a lawsuit filed by freelance photographer Larry Birkhead, who claims that he – and not Smith's fiancé Howard K. Stern – is the father of the infant. "If I was on anybody's Christmas list, they can scratch me off because this is the best Christmas present I could have ever received," Birkhead told PEOPLE.


California judge orders paternity test for Anna Nicole Smith's baby

LOS ANGELES (AP) - Anna Nicole Smith has been ordered to bring her infant daughter to California for paternity tests sought by a former boyfriend who claims he is the father, the man's publicist said.

"Los Angeles Superior Court has ruled today that Anna Nicole Smith and three-month-old baby daughter Dannielynn are ordered to submit to paternity testing," read the statement from Luck Media & Marketing Inc., released Thursday. Smith's ex-boyfriend, Larry Birkhead, welcomed the ruling.

"Christmas has come early, and I thank God that I will soon have the opportunity to prove that I am the father . . . and eventually hold her in my arms," Birkhead said in his statement.

Smith's attorney, Ron Rale, would not deny or confirm the ruling.

A Superior Court spokeswoman declined to confirm the order, saying paternity cases are confidential.

"I don't understand it," Smith blathers. "I do these diet products. I do TrimSpa ... [but] she was never fat ... I swear, it's crazy!"

We're sure that's just the pills talking.
